1. Acceptance of the terms
By accessing, browsing, or otherwise using the Site, you represent that you have read, understood, and accepted these Terms and Conditions, as well as the Privacy Notice incorporated herein by reference. Acceptance is deemed granted by the mere act of using the Site, with no registration, subscription, or additional signature required.
If you use the Site on behalf of a company or organization, you represent that you have sufficient authority to bind it, and these terms shall apply to both you and that entity.
2. Description of the Site
The Site is strictly informational and serves as a commercial presentation. Its purpose is to describe Lumora, its software development services, its working approach, and its contact details, as well as to allow prospective clients —primarily businesses (B2B)— to reach us through the contact channels published on the Site, mainly WhatsApp.
The Site does not constitute a binding offer, a firm commercial proposal, or a service agreement. Any information, reference prices, timelines, or capabilities described are illustrative and may change without prior notice.
3. Permitted use and prohibited conduct
You agree to use the Site in accordance with the law, good faith, public order, and these terms. Any use that may damage, overload, disable, or compromise the Site or the experience of other users is prohibited. In particular, you may not:
- Access or attempt to access areas, systems, or data not intended for the public, or circumvent security measures.
- Introduce or spread malicious code or viruses, or carry out denial-of-service attacks or mass/automated scraping without authorization.
- Send false information through our contact channels, impersonate third parties, or send unlawful, defamatory, or unsolicited (spam) content.
- Reproduce, copy, distribute, or commercially exploit the Site's content without Lumora's prior written authorization.
4. Intellectual property
All elements of the Site —including, without limitation, the name and trademark "Lumora," the logo, texts, design, visual layout, graphics, images, source code, and other content— are the property of Lumora (Lumora Consulting S.A.S.) or its legitimate owners, and are protected by Mexican and international intellectual and industrial property law.
Except with Lumora's express written authorization, no license or right is granted to use, reproduce, modify, or distribute such elements. Access to the Site does not transfer any intellectual property rights to you.
5. Content provided "as is" and absence of warranties
The Site's content is provided "as is" and "as available." Although we strive to keep the information accurate and up to date, Lumora does not warrant that it is free of errors, omissions, or outdated information, nor that the Site will operate uninterrupted or be available at all times.
To the extent permitted by applicable law, Lumora disclaims all implied warranties, including those of merchantability, fitness for a particular purpose, or non-infringement. The information on the Site is not a substitute for specific professional advice.
6. Limitation of liability
To the maximum extent permitted by applicable law, Lumora shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the access, use, or inability to use the Site, nor for decisions you make based on its content.
Lumora is likewise not responsible for interruptions, technical failures, data loss, or the presence of malicious software beyond its control. Nothing in these terms limits any liability that, under applicable law, cannot be excluded.
7. Links to third-party sites and services
The Site may contain links or access to third-party services, such as WhatsApp (+52 81 3156 0416), email, or other platforms. These links are provided solely for your convenience. Lumora does not control and is not responsible for the content, privacy policies, or practices of such third parties.
When you access a third-party service, you become subject to that provider's terms and privacy notices. We recommend reviewing them before use.
8. Privacy and data protection
The processing of any personal data you provide through our contact channels (mainly WhatsApp) is governed by our Privacy Notice, prepared in accordance with the Federal Law on the Protection of Personal Data Held by Private Parties (LFPDPPP). That notice describes the purposes of processing and how to exercise your ARCO rights (Access, Rectification, Cancellation, and Objection) before Lumora.
The Site does not use advertising or marketing cookies. The only storage in your browser is a local storage key ("lumora-lang") that remembers your language preference; it is strictly necessary for that function and is not used for tracking. If you visit us from the European Union, please note that processing may additionally be subject to the General Data Protection Regulation (GDPR); in that case, your rights will be honored in accordance with that regulation.
9. Contracted services: separate agreement
These Terms and Conditions govern only the use of the Site, not the provision of services. Any software development, consulting, audit, or other service you contract with Lumora shall be governed by a separate Service Agreement, proposal, or quotation signed between the parties, which shall prevail over the Site's informational content as to scope, pricing, timelines, warranties, and liabilities.
No content on the Site shall be construed as a contractual commitment until such a signed agreement exists.
10. Modifications to the terms
Lumora may modify these Terms and Conditions at any time for legal, technical, or business reasons. The version in force shall always be the one published on the Site, bearing its last-updated date. Continued use of the Site after changes are published constitutes acceptance of the modified terms.
We recommend reviewing this page periodically to stay informed.
11. Applicable law, jurisdiction, and contact
These Terms and Conditions are governed by the laws of the United Mexican States. For their interpretation, performance, and any dispute arising from them, the parties submit —unless otherwise confirmed by contract— to the jurisdiction of the competent courts of San Pedro Garza García, Nuevo León, Mexico, waiving any other jurisdiction that might correspond to them by reason of their present or future domicile.
